First Drafts of Forms W-8BEN Available – Reflect FATCA Changes

Draft, modified Forms W-8BEN for individuals and entities have been released. As previously noted here, the IRS has split the Form W-8BEN into two forms: one for individuals (Form W-8BEN) and another for non-individuals (Form W-8BEN-E). The W-8BEN for individuals requires a foreign tax identification number.

W-8BEN-E for Entities

The W-8BEN-E for non-individuals includes over twenty FATCA entity classification types with corresponding FATCA certifications for each type. The form itself is six pages long. The foreign TIN requirement has been added. Changes to the certification language were also made.

Form W-8IMY to be released soon

We understand that a draft Form W-8IMY should be available by the end of the month. It should generally follow the format of the Form W-BEN–E. Additionally, we understand that the Forms W-8ECI and W-8EXP should not significantly change.
